The project being developed by the Ministry of Climate aims to raise the basic limit of electricity consumption covered by price freezes, reduce the maximum electricity price for local governments and the SME sector, and introduce a solidarity contribution for companies operating in the coal sector.
The government’s legislative work list announced that work is underway to amend the law on special solutions aimed at protecting electricity consumers in 2023. These changes are dictated by the situation in the electricity market and certain other laws.
Continuation of Price Freezes
The aim of the project is to further minimize electricity price increases for the most vulnerable consumers, strengthen the energy security of the state by maintaining an appropriate level of liquidity and the ability to meet obligations, and ensure continuity of energy supply. It is necessary to maintain the existing protective solutions that have been in place since 2022.
The legislative work list informed that the amendment project provides for the introduction in 2023 of solidarity contributions for large entities in the coal sector, which involve, among other things, the implementation of a mechanism to identify entities that achieved excessive profits in 2022, according to the EU classification described in EU Council Regulation No. 2022/1854. Such entities will be required to pay excess profits earned in 2022 to the Price Difference Payment Fund.
Additionally, it was emphasized that the project aims to maintain and strengthen the support mechanism for vulnerable consumers and those essential for the economy.
“The proposed regulations also include modifications to the provisions concerning the freezing of electricity prices for households and the establishment of a maximum price for local government units, small and medium-sized enterprises, and entities performing important public utility tasks.”
Increase in Electricity Consumption Limits for Households
As explained, the aim of the project is to provide broader support to consumers in households by raising the basic limit of electricity consumption covered by price freezes.
“Moreover, the change provides for a reduction in the maximum electricity price for local government units, small and medium-sized enterprises, and certain public utility entities,” it was reported.

In 2022, regulations were adopted that froze electricity prices at the 2022 level up to certain limits in 2023. For households, this is 2000 kWh per year; for households with disabled persons up to 2600 kWh, and for families holding the Large Family Card and farmers, the limit is up to 3000 kWh. After exceeding these limits, a maximum price of 693 PLN per 1000 kWh applies.
